Strath Tirry S42 SEIR – Application under Section 42 of the Town & Country Planning (Scotland) Act 1997 (as amended) in relation to Strath Tirry Wind Farm to seek variation to Condition 21 (Shadow Flicker) of 20/05067/FUL
REG & Renantis have submitted an application under Section 42 of the Town & Country Planning (Scotland) Act 1997 (as amended) in relation to Strath Tirry Wind Farm. The application seeks to vary a Planning Condition (C.21) of the existing planning permission dated 7 June 2022.
In addition, the Applicant requests more time to commence the Development than the 3 years provided for in the extant planning permissions (which states that implementation must take place by 7th June 2025). No physical changes to the Development or amendments to the red line boundary are proposed. The application is supported by a Planning Statement and a Supporting Environmental Impact Report (SEIR) which updates planning policy and associated environmental assessments linked to those updates identifying relevant planning policy considerations that must be taken into account in the determination of this application.
No changes to the predicted environmental impacts of the Development are identified. For clarity, the proposed amendment being applied via this Section 42 application makes no difference to the physical, consented scheme.
